Resolving child maintenance issues

• Directly agreeing on maintenance payments with your former partner, also referred to as a family-based arrangement. This is the cheapest and least time-consuming way of agreeing on child maintenance. The government provides a helpful online calculator which sets out the amount a parent should pay the other based on different criteria and circumstances.

• Through The Child Maintenance Service, which is a government scheme that calculates the maintenance payment for you. If you cannot negotiate and agree on the amount of maintenance or one parent fails to make the payments they have agreed to, an application can be made to the CMS (Child Maintenance Service). The CMS is a government-run agency that arranges and collects maintenance payments. You will have to pay additional charges and potential financial penalties if the Child Maintenance Service is forced to get involved with your case.

• Court Order – This is when the court has the power to set maintenance payments. Typically, court orders are used when the paying parent has a higher income or lives abroad.

In most circumstances, child maintenance is paid until your child reaches 16 (or 20 if they continue in full-time education).
